Paraguayan immigrant arrested at court hearing, judge rules detention violated due process

Nov 1, 2025New York, NYParaguay

Carlos Guerra Leon, an 18-year-old recent high school graduate from Spring Valley, New York, was arrested without a warrant by federal officers on August 9, 2025, and transferred to Jackson Correctional Facility in Louisiana despite holding approved Special Immigrant Juvenile Status (SIJS) and deferred action status that protected him from deportation under the Biden administration. He came to the U.S. from Guatemala at age 10 after experiencing abandonment and neglect, and had built a stable life attending school and working legally in New York. The National Immigration Project, ACLU of Louisiana, and Robert F. Kennedy Human Rights filed a federal habeas petition challenging his detention. After nearly three months in custody over 1,000 miles from home, Federal Judge Terry Doughty issued a temporary restraining order on October 31 ruling Guerra Leon's detention unlawful and that his release "serves the public interest by ensuring that the Government adheres to its own laws." Despite the court order, ICE officials at the Louisiana facility initially refused to release him, claiming to have "no knowledge" of the ruling and forcing an emergency motion before he was finally released and returned home to New York.

Oct 31, 2025New York, NYEcuador

Monica, an Ecuadorian child care worker seeking asylum, was pushed to the ground and shoved into a wall by an ICE agent outside a Manhattan immigration court on September 25, 2025, while agents detained her husband Ruben. The incident, which occurred in front of the couple's two young children and journalists, was captured on video and circulated widely on social media. Monica said she feared Ruben's deportation would amount to a death sentence. The officer, who reportedly had a history of aggressive conduct at the same location, was temporarily relieved of duty after DHS called the conduct unacceptable, but was reinstated days later following a preliminary review despite political calls for felony charges. In late October, a federal court ordered Ruben's release after finding he had been detained without explanation. The family of four has since been reunited, though their asylum cases remain pending.

ICE smashes van windows, uses facial recognition on Oregon farm workers without warrants

Oct 30, 2025Woodburn, OR

MJMA, a 45-year-old farm worker and lead plaintiff in a class-action lawsuit, was detained in a van stop by ICE agents who smashed the vehicle's windows without waiting for occupants to comply with commands. Body-camera footage shows MJMA asserting her right to remain silent and requesting a lawyer in Spanish, while an officer broke her phone as she called 911. Agents used facial recognition software to scan her face multiple times, obtaining inaccurate matches—one incorrectly identifying her as "Maria"—and falsely claiming she entered the country unlawfully when she had actually arrived with a valid temporary visa. A federal judge ruled the arrests unlawful and unjustified, finding officers engaged in misconduct, made inaccurate statements in reports, and improperly used facial recognition technology without warrants. MJMA has an ongoing asylum case.

Oct 29, 2025Lords Valley, PASlovakia

A Slovak national who entered the U.S. in 2015 on a visa waiver and later overstayed was detained by immigration officials near his residence in October 2025 and held at Pike County Correctional Facility in Pennsylvania. He had pending applications for a green card through his U.S. citizen spouse and for work authorization, and later sought asylum, withholding of removal, and protection under the Convention Against Torture, all denied by an immigration judge in March 2026. He says he endured months of physical and mental abuse in detention, and his family said he was removed without notice to them or his attorney; he and his family, working with the ACLU, then filed a federal habeas corpus petition seeking to block his deportation. In July 2026, a federal district court in Pennsylvania ruled it lacked jurisdiction over his claims, dismissed the petition, vacated an earlier temporary stay of removal, and denied his request for a restraining order as moot.

He is experiencing health complications related to high blood pressure during his continued detention. On August 7, 2026, the federal court granted Petitioner's emergency motion for a temporary restraining order, enjoining respondents from deporting him or removing him outside the district while his petition is pending. Protesters and city officials said the students were beaten and assaulted by officers, with one left with blood on his face; a teacher said she realized one student was missing only when taking attendance. When residents gathered to oppose the sweeps, agents in camouflage and gas masks deployed tear gas and pepper spray, with video showing Bovino tossing a canister into the crowd despite a court order restricting such force. Additional arrests, including two staff members of a local alderman, occurred in Little Village and suburban Cicero, and a federal judge ordered Bovino to testify and appear at a status hearing.

Man held in jail for weeks despite court-ordered release, ACLU sues over ICE partnership

Oct 16, 2025Las Vegas, NV

The ACLU of Nevada filed a lawsuit challenging Las Vegas Metropolitan Police Department's 287(g) partnership with ICE, which allows local officers to hold undocumented immigrants for transfer to federal agents. The case centers on Sergio Morais-Hechavarria, a 36-year-old man arrested in August who pleaded guilty to attempted possession of a stolen vehicle. After completing his criminal sentence, a judge ordered his release to an inpatient treatment facility, but Metro detained him on an ICE immigration hold for weeks beyond his release date. On October 16, Morais-Hechavarria was transferred to a Texas immigration facility without notice to his attorneys and in violation of the court order. The ACLU contends the 287(g) partnership violates Nevada state law and Dillon's rule, which prohibits local agencies from exercising powers not authorized by the Legislature.

Federal judge rules ICE's warrantless arrests at Liberty restaurant unlawful, extends settlement terms

Oct 10, 2025Liberty, Missouri

On February 7, 2025, ICE officers arrested 12 employees at El Potro Mexican Restaurant in Liberty, Missouri while searching for a registered sex offender. A federal judge ruled that 11 of the arrests were unlawful, finding that ICE lacked probable cause to justify warrantless arrests and violated a legal settlement agreement requiring probable cause that a person is likely to escape before making such arrests in the Midwest region. The judge found that the restaurant owner was not informed that employees had the option to refuse speaking with agents. The National Immigrant Justice Center brought the case challenging the raids. The federal judge extended the terms of the settlement agreement through February 2026.

Families were denied proper goodbyes, and detainees were not searchable in ICE's locator system. Some were subsequently deported or transferred to other detention facilities without proper legal proceedings.
