Billings father and 9-year-old ordered released after Havre detention

U.S. District Court Judge Brian Morris ordered the release of Adrián Espinoza De La Cruz and his 9-year-old child within 24 hours, ruling that their warrantless arrest and detention at the Havre Border Patrol Station violated their constitutional rights. Morris noted neither the father nor child had any prior criminal history or law enforcement encounters. The judge also cited concerns over the facility's lack of proper bedding and basic amenities, and the child's ongoing gastrointestinal medical needs. The U.S. Attorney's Office had acknowledged the arrest occurred without a warrant but said one was issued afterward.

Cuban boy deported to Guyana with father left alone after father's sudden death

Hundreds of unaccompanied Mexican children deported to southern Mexico, stranded without resources

The United States has deported hundreds of unaccompanied Mexican children on flights to southern Mexico cities including Tapachula, Villahermosa, and Mérida, where human rights organizations confirm more than 350 cases. Many children lack resources to return home safely and have become stranded in unfamiliar cities with inadequate local support services. Some children have disappeared from shelters, and human rights advocates have received information suggesting possible deaths of at least three children attempting to return to their home communities. The policy, discovered in December 2024, represents a shift from prior practice of rapid deportations at the land border where children received care through Mexico's child welfare system.

ICE detains at least 33 in NY Capital Region sweep, splits family

On August 10, 2026, ICE agents detained at least 33 people across the Capital Region of New York, including Albany, Schenectady, and Colonie, in more than 15 separate incidents over roughly six hours. Among those detained was an Ecuadoran family of four — parents Kevin Ushiña and Veronica Saquillo and their children, ages 5 and 9 — who had lived in Albany for two years and had withdrawn from the asylum process the previous year over fears of detention at a check-in. The mother and children are being held at the Dilley Detention Center in Texas, while the father is held in a facility in western New York. Albany Mayor Dorcey Applyrs said she was “deeply unsettled” by the increased ICE activity and met with local advocacy coalitions supporting affected families.

Guatemalan teen sponsored by aunt detained by ICE outside his Daly City home

A Guatemalan teenager who fled to the US in 2022 at age 16 to escape domestic violence has lived in the country for about four years. He was initially processed as an unaccompanied minor, held by DHS/ORR, and released to his aunt, a vetted sponsor, after being deemed neither a flight risk nor a danger to the community. He currently lives in Daly City with his mother, works at a Korean restaurant, and has no criminal history. On August 10, 2026, four ICE officers arrested him outside his home, handcuffed him despite his complaints of pain, and drove him to a parking structure where he was pressured to sign a document. He filed a Petition for Writ of Habeas Corpus and a TRO motion challenging the lawfulness of his detention and seeking release plus protection from re-detention without notice and a hearing. The court found he was likely to succeed on his procedural due process claims and granted the TRO, ordering his immediate release, barring removal or transfer out of the district, and setting a show cause hearing for August 24, 2026.

Asylum seeker detained in inhumane border conditions at 11, now thriving in Southold community

Daniel Palencia arrived in the United States in 2016 at age 11 with his mother, crossing the Mexico-U.S. border at El Paso, Texas, where they turned themselves in to immigration authorities and sought legal status. He was detained for three months in deplorable conditions, including cold rooms where temperatures dropped at night and blankets were confiscated, and overcrowded holding areas he described as "cages" designed for 4-5 people but sometimes holding 40 individuals where "we were sleeping on top of each other." After being transferred to JK Airport in New York for additional detention, his family hired a lawyer and obtained asylum status. Palencia moved to Southold to live with his grandparents, attended local schools, and has worked for Marcello Masonry for two years. Reflecting on his experience and that of detained coworker Hugo Leonel Ardon Osorio, he stated: "There are bad people out there. But you can't arrest everybody for the way they look or if they speak Spanish. You can't arrest hard-working people who are trying to support their families."

Teen and father detained at ICE check-in, held in Georgia, later released on bond

An 18-year-old and his father were detained during a required immigration check-in, according to the ACLU of North Carolina. The pair were held at a detention facility in Georgia before being granted bond, and the son was released on Aug. 7, 2026.

Venezuelan mother detained after traffic stop seeks bond hearing amid medical condition and family hardship

A Venezuelan woman who entered the United States without authorization in September 2023 was ordered removed by an immigration judge in March 2026; her appeal to the Board of Immigration Appeals remains pending. She was detained by ICE on August 6, 2026 following a routine traffic stop and has since been held at the South Louisiana ICE Processing Center in Basile, Louisiana. She filed a pro se habeas petition alleging that her prolonged detention without a bond hearing violates due process, that her warrantless arrest violated the Fourth Amendment, that a serious medical condition has been aggravated by her detention, and that her detention imposes a hardship on her minor children. She sought immediate release or, alternatively, an emergency individualized bond hearing, along with a temporary restraining order barring her removal or transfer while the petition is pending. The court denied the emergency motion, finding that the request for a bond hearing sought the ultimate relief of the habeas petition itself and that claims of imminent removal or transfer were speculative.

ICE held in contempt for deporting 50+ asylum-seeking minors despite court order

A Maryland federal judge held ICE in civil contempt for wrongfully deporting more than 50 unaccompanied minors in violation of a blanket court order barring their removal. The judge found that subsequent efforts to bring some of the minors back did not remedy the initial violation.

11-year-old boy Diego faces deportation alone in immigration court without lawyer

An 11-year-old unaccompanied migrant named Diego appeared alone before an immigration judge in New York City without legal representation, struggling to complete an asylum application in English. The hearing occurred after a federal contract funding legal services for detained immigrant children expired on July 31, leaving thousands of minors to represent themselves. Judge Lisa Ling, a former ICE prosecutor, gave Diego two and a half weeks to file his asylum application or face deportation, despite his expressed fear of returning to Guatemala. Multiple other unaccompanied children, some as young as 11, appeared in court that day without lawyers or adult advocates.

Young Indian asylum seeker with pending guardianship case detained after unrelated search warrant, wins court-ordered bond hearing

The petitioner, a citizen of India who entered the United States in July 2025 at around age 20, had a pending asylum application filed with USCIS in October 2025 and had been granted employment authorization valid through December 2027. In March 2026, his guardian petitioned a California state court for guardianship, which was granted in May 2026 after the court found that reunification with his parents was not viable due to abandonment and that returning him to India was not in his best interest. Based on those findings, he submitted a special immigrant juvenile status petition to USCIS. On August 5, 2026, ICE detained him at a residence where federal law enforcement was executing a search warrant during an active shooting investigation, though he was not accused of any crime. He filed a habeas corpus petition and a motion for a temporary restraining order challenging his detention as a due process violation, arguing he had a protected liberty interest given his sanctioned presence in the country. The court agreed, finding his circumstances similar to a prior case where a detainee's employment authorization constituted government sanctioning of his continued presence, and ordered a bond hearing. The court required the government to prove by clear and convincing evidence that he is a flight risk or danger to the community, and denied the TRO motion as moot given the bond hearing order.

Trafficked, abused teens ordered deported despite pending legal status, lawsuit says

Jewish Family and Community Services of Pittsburgh (JFCS) filed a federal lawsuit against the Trump administration alleging policies push unaccompanied immigrant children toward deportation even when they qualify for legal status. The suit names six teen plaintiffs from Vietnam, Guinea, El Salvador and Guatemala, all described as victims of abuse, abandonment, neglect or trafficking. Among them is KTN, a 19-year-old from Vietnam who fled severe, repeated physical abuse by his father and was approved for Special Immigrant Juvenile status in May, yet was ordered deported in July. Another plaintiff, 17-year-old Guatemalan trafficking survivor FYCT, was ordered deported despite applying for T nonimmigrant status after being confirmed as a trafficking victim. The lawsuit alleges immigration judges have been instructed to deny children meaningful time to pursue pending applications, citing government data showing removal and voluntary departure orders against minors have nearly quadrupled. JFCS staff say hundreds of their young clients are at risk, and the filing coincided with two Pittsburgh-area members of Congress questioning the administration's decision to end a contract funding attorneys for roughly 20,000 unaccompanied children nationwide, including about 700 in Pennsylvania.

Honduran man with SIJS deported, returned by court order, still detained in Texas

José Eliezer Martínez-Andino, a 20-year-old Honduran man who crossed into the U.S. alone at 14 in 2020, was deported to Honduras in April 2026 after being stopped by Border Patrol in Montana over an alleged forged license plate, despite holding Special Immigrant Juvenile Status granted in 2023. He said he signed a voluntary departure form out of fear during detention but repeatedly tried to rescind it while being moved among at least six facilities, a claim DHS disputes, saying he received full due process. He had been living in Raleigh with relatives and is the father of a three-year-old U.S.-born child. In June 2026, U.S. District Judge Beryl Howell ordered DHS to return him and restore his legal status; he came back on August 5, 2026, but was sent to a detention facility in Harlingen, Texas, where he remains held awaiting relief.

Children exposed to arsenic, lead at now-closed Miami detention center

Migrant children as young as six were detained at the Homestead facility adjacent to Homestead Air Reserve Base, a Superfund site with roughly 16 pollution sources including arsenic and lead, according to over 20,000 pages of records released in federal litigation. The records link the contamination to risks of cancer, kidney and liver damage, immune-system harm and developmental delays, and show no documented environmental assessment, cleanup or hurricane plan at the site. The facility, which closed in 2019, also exposed children to constant noise from F-16C fighter jets, with some detainees separated from their parents at the U.S.-Mexico border. Earthjustice sued the Air Force, DHS and ICE in 2021 to obtain the records, and the federal government has agreed to pay legal fees now that the litigation has concluded; officials declined to comment.

Immigration agent arrested for holding teenager at gunpoint in Riverside County

An off-duty ICE or Border Patrol agent named Gerardo Rodriguez was arrested on November 11 after pulling a firearm on a 17-year-old during a traffic stop in Riverside County. The teenager was detained for nearly 20 minutes on the side of the road after being stopped while driving through the neighborhood. This incident is part of a growing pattern of ICE agents confronting people and demanding identification.

Honduran mechanic returns to U.S. custody after judge's deportation order

Jose Eliezer Martinez-Andino, a 20-year-old mechanic from Raleigh, North Carolina, and father to a U.S.-citizen daughter, was deported to Honduras in April after agents detained him in Montana, denied him contact with attorneys for about ten days, and had him sign a voluntary-departure form despite his Special Immigrant Juvenile Status and work permit. U.S. District Judge Beryl Howell found the removal denied him due process, calling the circumstances "coercive," and ordered the government to return him; he said he had been afraid in Honduras due to childhood abuse by his father. He flew back to Texas on Aug. 5 after about five months abroad, was held in CBP custody, and was then transferred to ICE custody at the Port Isabel Processing Center, where he awaits a bond hearing to determine whether he can continue proceedings closer to Raleigh. DHS has disputed his account, saying he entered the country without authorization and was released by the Biden administration, and denies he was blocked from contacting legal counsel.

Colombian couple detained by ICE at Las Vegas airport during birthday trip

Diana Rodríguez Pardo and Jairo Alzate Elejalde, a Colombian couple with Spanish citizenship, were detained by ICE agents immediately after landing at Las Vegas International Airport, where they had traveled from California to celebrate a birthday. The couple had entered the U.S. legally about two years earlier under a visa waiver program and later filed for asylum before their 90-day authorization expired. They were separated and sent to different detention facilities—Jairo remained in Nevada while Diana was transferred first to Arizona and then to Denver, Colorado. Their two children, ages 8 and 16, are now being cared for by relatives, and the family is seeking an immigration attorney and raising funds to cover legal costs while pursuing a possible bail release.

16-year-old detained by ICE en route to church, father arrested when picking her up

Emely Charloth Suaza Chambo, a 16-year-old student at Churchill High School in San Antonio, was detained by ICE while on her way to church. ICE agents told her father, Fernando Suaza Ortiz, who was employed at the Hilton Garden Inn, to pick her up or she would be sent out of state. When he arrived at the location to collect his daughter, he was also taken into ICE custody. Both have pending asylum cases and are being held at the Dilley detention facility in Texas. Congressman Joaquin Castro shared their story on social media.

18-year-old detained by masked agents in Glendale now held at Adelanto ICE facility

An 18-year-old was detained by masked individuals alleged to be federal agents during an operation on the 400 block of West Glenoaks Boulevard in Glendale, California, and forced into an unmarked vehicle. Video of the incident shows the teenager struggling with the agents, calling out in Spanish for help and his mother, and repeatedly stating he did nothing wrong. Bystanders attempted to intervene but were warned they could be arrested for interfering. He is currently being held at the Desert View ICE facility in Adelanto, California, pending removal proceedings, and federal officials say he had previously been encountered by Border Patrol near El Paso, Texas, in January 2024.

Mother and 6-year-old daughter detained after reunification, sent to family detention center

Aurora, 24, and her six-year-old daughter were detained by ICE and sent to a family detention center in Texas. The daughter had arrived at the U.S. border alone and spent more than six months in a child migrant shelter before reuniting with her mother in late March. The detention occurred after the Office of Refugee Resettlement shared information about unaccompanied children, their sponsors, and household members with ICE.
