Asylum seeker with breast cancer detained after traffic stop, denied medical care and process

Aug 29, 2026Adelanto, CAChina

The petitioner, who was lawfully admitted to the U.S. on a B-2 visa in March 2025, has resided in the country since then and applied for asylum in January 2026, a claim that remains pending. On August 29, 2026, she was detained after the vehicle she was riding in as a passenger, driven by her boyfriend, was stopped; the document states no process was provided to her during the detention. She is now in removal proceedings and has been held at the Adelanto ICE Processing Center. She has a history of breast cancer and takes related medication, and imaging taken since her detention showed a mass or tumor in her breast, yet for more than two weeks she received no follow-up care or prescribed medication. She filed a habeas corpus petition and a TRO application seeking release, arguing her detention violated due process. The government did not respond to the petition despite a court-ordered deadline, and the court granted the petition, ordering her immediate release on reasonable conditions without monetary bond.

The two were held together for more than a month at the South Texas Immigrant Processing Center in Dilley. U.S. Rep. Joaquin Castro visited the family and said Bracho was moved to tears with guilt, believing he was responsible for his daughter's detention. Their case drew concern from family members, activists, and Katherine's classmates before the two were released together from Dilley.

Solano entered the United States legally in January 2015 on a journalist visa and filed for asylum in December 2015 after being persecuted in Venezuela for his journalism covering opposition political campaigns and figures including Henrique Capriles and Julio Borges. In August 2011, he and his cameraman were beaten by municipal officials while covering news. He previously worked for Globovisión from 2002 to 2008 and founded and directed the news agency Zorro Comunicaciones. At the time of his detention, Solano held a valid Florida work permit and driver's license. He had been granted Temporary Protected Status beginning in 2021, which expired in September 2025. According to his wife María Moreno and the Venezuelan Journalists Abroad Association (Apevex), officers detained him without a judicial warrant and without criminal charges, telling him his asylum case could take another decade and that he was in irregular immigration status. DHS confirmed the arrest and stated Solano has no immigration status allowing him to remain in the U.S. He was transported to CBP headquarters in Dania Beach with removal proceedings and an immigration court hearing scheduled for August 26, 2026.

Kansas father detained by ICE while driving National Guardsman son to disaster duty

Aug 26, 2026Garnett, KSMexico

William Israel Martinez Ruiz, 42, a construction worker from Kansas City, Kansas, was pulled over by Anderson County sheriff's deputies in Garnett on August 24, 2026, for a burned-out license plate light while driving his son, Kansas Army National Guard member Louis Martinez, to a state active duty mission for storm disaster cleanup. Deputies discovered his driver's license was expired and questioned him and his wife about their immigration status; he was arrested for driving without a valid license. Under the county's 287(g) agreement with ICE, a detainer was issued the same day, and ICE arrested him on August 26 for unlawful presence. Martinez Ruiz, who had previously held a U visa but did not renew it, is being held without bail at the CoreCivic-operated Midwest Regional Reception Center in Leavenworth, with a bond hearing scheduled for October 14; his family says he has a pending application to legally remain in the country. ICE has also cited a 2024 federal trespassing arrest it said occurred in Virginia, but his son disputed the location and court records show the incident actually took place at Fort Leonard Wood, Missouri, where the case was later dismissed. His son said, "I'm serving this country, I'm proudly serving, and I love the mission I took on. It honestly feels like betrayal."

The agency said Morocho-Arteaga had entered the U.S. without authorization and was previously arrested and released by Customs and Border Protection in July 2021, and that agents found a kitchen knife in his vehicle during the stop. DHS said the child associated with him remains under the guardianship of her mother, and that Morocho-Arteaga remains in ICE custody pending removal proceedings.

Tirado Pantoja, who has a U.S. citizen son and stepdaughters and is in a common-law marriage with a legal permanent resident, disputed ICE's account of the shooting, saying agents were never in front of the van when they opened fire. Held at the Montgomery Processing Center in Conroe, he lost 20 to 30 pounds and suffered depression linked to the trauma of the shooting and detention conditions, according to advocates supporting his family. U.S. District Judge Alfred Bennett ruled his detention violated due process and ordered his release, and he was reunited with his wife outside the detention center on August 26, 2026.

Aug 25, 2026Austin, TXMexico

Victor Martinez Nieto and his 5-year-old son, Liam Tadeo, were detained by ICE agents during a traffic stop in North Austin on August 16, 2026, while driving to a children's soccer game. Video showed Liam crying and clutching his handcuffed father's hands; a family spokesperson said Liam had been due to start kindergarten that week. The two were held together at the South Texas Family Residential Center in Dilley, where attorney Kate Lincoln-Goldfinch said officials denied requests to release Liam to his mother in Austin rather than risk him being placed alone in Office of Refugee Resettlement custody. DHS said Martinez Nieto had entered near Laredo in 2022, was arrested in November 2025, and had reentered after a prior deportation. Lawmakers Joaquin Castro, Greg Casar, and James Talarico called for the pair's release and for Dilley's closure, with Castro denied a facility visit. Martinez Nieto agreed to depart voluntarily with his son, and the two were deported to Mexico, reuniting with relatives with help from the Mexican Consulate, while Liam's mother sought ways to reunite with him.

Luis Manuel Aviles, 48, a Nicaraguan handyman who has lived in Key West, Florida for about 19 years, was detained by Border Patrol agents during a traffic stop while driving to drop his car off at a mechanic near a Publix supermarket. Family members said he holds a work permit, Social Security card, and driver's license, has a pending asylum application, and has no criminal record. His son, Navy sailor Joshua Aviles, was more than nine months into a deployment aboard the USS Abraham Lincoln in the Middle East and called his father a 'hardworking, humble man,' describing the arrest as heartbreaking. His wife, Argelia Aviles, said, 'He dedicates himself only to work so he can put food on the table at home. He is a good father,' while his stepdaughter said her half-brother struggled to sleep and eat afterward. DHS said having a family member in the military does not confer legal status or immunity from enforcement. An immigration judge dismissed the case against Aviles days later, and he was released from custody, with his family thanking supporters and asking for privacy. His case is among dozens identified nationally involving parents and spouses of active-duty troops.
