Guatemalan father detained 9 months wins release after immigration judge failed to justify continued detention

Aug 26, 2025Los Angeles, CAGuatemala

A Guatemalan father of three, a native and citizen of Guatemala, has resided in Los Angeles with his family for many years and has three biological children who are United States citizens. He was arrested by immigration authorities on August 26, 2025, and has been detained at the Adelanto ICE Processing Center since that time. He is pending removal proceedings and is seeking Cancellation of Removal relief. An immigration judge denied bond at two hearings—one on January 12, 2026 (where he bore the burden of proof) and another on March 2, 2026 (where the government bore the burden)—based solely on his prior DUI conviction and immigration history, without adequately considering his family ties, stable residence, or lack of criminal history involving moral turpitude. The federal magistrate judge found the March 2, 2026 bond denial was an abuse of discretion because the immigration judge failed to conduct an individualized assessment, consider mitigating factors, or address alternatives to detention as required by the Rodriguez class action injunction. The court ordered his immediate release on his prior conditions of supervision and enjoined further detention without a compliant bond hearing.

Venezuelan priest detained at Miami airport despite valid religious visa, later released

Aug 20, 2025Miami, FLVenezuela

Catholic priest Gustavo Andrés Santos Higuera, a Venezuelan national born in Valencia in 1993 who moved to the U.S. in 2012, was denied reentry by Customs and Border Protection at Miami International Airport on August 19, 2025, while returning from an international trip via London, despite holding a valid R-1 religious-worker visa valid through November 2025. Santos, ordained a deacon in 2022, had served as parochial vicar at St. John Neumann Church in Miami since 2023. Archbishop of Miami Thomas Wenski and pro bono attorneys from Catholic Legal Services petitioned a federal court for his release, alleging he was denied access to counsel, and asked that authorities be barred from transferring him out of Florida. The Archdiocese called the detention 'unexpected and unjust.' CBP later reconsidered and released Santos, allowing him to resume his ministry, though he subsequently resigned from the parish to take another assignment, surprising parishioners who praised his pastoral work. His case reportedly prompted USCIS to ease certain R-1 visa renewal requirements for religious workers.

Jul 31, 2025San Francisco, CA

Carmen Aracely Pablo Sequen was arrested by ICE agents as she was leaving San Francisco immigration court on July 31, 2025, and detained at ICE's San Francisco field office. She filed a habeas corpus petition the next day seeking her immediate release and a permanent injunction prohibiting ICE from re-detaining her without prior notice and a hearing before a neutral arbiter. After the court granted preliminary injunctive relief, she amended her petition to add three additional plaintiffs—Ligia Garcia, Yulisa Alvarado Ambrocio, and Martin Hernandez Torres—who also sought individual habeas relief. The amended complaint added seven class action claims seeking to vacate certain ICE and EOIR policies under the Administrative Procedure Act and to enjoin allegedly unconstitutional conditions of confinement at ICE's San Francisco field office. The government moved to sever the individual habeas claims from each other and from the class claims. The court granted the motion to sever but denied the government's request to randomly reassign the severed cases to other judges.

Jul 10, 2025Portland, ORHonduras

Jackie Merlos, an undocumented immigrant mother from Honduras with a pending U-visa, was detained by CBP agents on June 28, 2025, at Peace Arch Park near the U.S.-Canada border during a family picnic. Merlos, a well-regarded local business owner who had lived in Portland, Oregon for decades, was held in a CBP facility for 12 days. An ICE agent then called Merlos' friend Mimi Lettunich, demanding she immediately pick up Merlos' four U.S. citizen children—9-year-old triplets and a 7-year-old—or they would be placed in foster care. Lettunich, who had not cared for young children in years and had a full-time job, took the children into her home. Federal authorities attempted to deport Merlos without proper documentation or due process, but a federal judge issued a temporary restraining order blocking the children's removal. As of July 2025, Merlos remained in ICE custody at a facility in Tacoma, Washington, separated from her children and facing formal removal proceedings.

Palestinian-born man detained by ICE for nine months wins habeas corpus case

Jul 7, 2025Palestine/Kuwait

A stateless man born in Kuwait to Palestinian parents entered the United States on September 5, 1982 with an F-1 student visa. He was ordered removed on July 18, 2007, with his removal order becoming final on December 12, 2007 when the Board of Immigration Appeals denied his appeal. He was designated for removal to Kuwait with Egypt as an alternative destination. After being released from ICE detention on July 3, 2008, he was re-detained on July 7, 2025 at a routine ICE check-in without notice or opportunity to contest the revocation of his release. Over nine months of continued detention, ICE made only one documented effort to secure travel documents—a letter sent to Egypt in January 2026, six months after his re-detention, with no response received. The court found no significant likelihood of removal in the reasonably foreseeable future and granted his habeas corpus petition, ordering his immediate release on the same conditions as before his re-detention, with protections against re-detention without a pre-detention hearing and restrictions on removal to a third country without due process.
