ICE arrested Oscar Evaristo Nunez, a Honduran national who entered the U.S. near Arizona around 2003, during a targeted enforcement operation on September 15, 2026. Nunez had been arrested by local authorities in Fairfax County in August 2025 on charges including aggravated sexual battery of a minor and nonconsensual videotaping of an undressed minor, and ICE lodged a detainer two days later, but the county released him without notifying the agency. DHS Secretary Markwayne Mullin and ICE Washington field office director Robert Guadian criticized Fairfax County's handling of the case, while a spokesperson for Fairfax Commonwealth's Attorney Steve Descano said the release delayed prosecutors' ability to seek justice and the victim's family's ability to get closure. Nunez remains in ICE custody pending immigration proceedings, and local criminal proceedings are continuing without him present.
