U.S. District Judge Michael Barrett ordered ICE to release Elisthene Petit Kat, a 38-year-old Haitian man living in Springfield, Ohio, or give him a bond hearing, rejecting the agency's claim that he is subject to mandatory detention as an 'arriving noncitizen.' Barrett wrote he was "puzzled" by ICE's position given Petit Kat has lived in the U.S. for years after being paroled in 2023, working at an auto parts factory, attending church regularly, and supporting a son still in Haiti; he was arrested during a traffic stop in Clark County after local police working with ICE pulled over the vehicle he was riding in. The Sixth Circuit Court of Appeals, along with most other federal appellate courts, has rejected ICE's interpretation of the law, and the U.S. Supreme Court has agreed to review the policy's legality. At least five other Haitian nationals — Darline Jean Baptiste, Peterson Nozil, Jean Alix Comper, Paulson Saintelien, and Jodas Etienne — have filed similar habeas petitions, and attorney Kathleen Kersh of ABLE said some federal judges are growing frustrated that immigration judges continue to disregard rulings finding such detainees are not subject to mandatory detention.
