New Mexico ICE detainees' petitions for due process hearings top 800

The number of habeas corpus petitions filed by immigration detainees in New Mexico federal courts seeking bond hearings has surpassed 800 since the no-bond policy began last July, with over 34,590 filed nationwide. Petitioners include a Chinese national who worked at a nail spa in New York, a Kyrgyzstan citizen from Illinois, and a Cameroon native with no criminal history who was re-detained in December 2025 while his asylum application was pending. Two federal appeals courts, the 5th and 8th Circuits, have upheld the no-bond detention practice, while the 10th Circuit, which covers New Mexico, has not yet ruled. To meet rising demand, criminal prosecutors in the U.S. Attorney's Office have been assigned to defend the policy alongside civil division attorneys.
