A woman from Congo who entered the United States in February 2025 was placed in removal proceedings and denied asylum, but an immigration judge granted her withholding of removal to both Congo and Senegal in December 2025. She remained in ICE detention for more than four months after that order, with no indication that authorities had sought travel documents or contacted embassies to remove her to a third country. She filed a habeas corpus petition arguing her continued detention violated federal law and her due process rights, and a federal judge in Arizona granted the petition in April 2026 after the government did not oppose her release, ordering she be freed from custody.
