Billings father and 9-year-old ordered released after Havre detention

U.S. District Court Judge Brian Morris ordered the release of Adrián Espinoza De La Cruz and his 9-year-old child within 24 hours, ruling that their warrantless arrest and detention at the Havre Border Patrol Station violated their constitutional rights. Morris noted neither the father nor child had any prior criminal history or law enforcement encounters. The judge also cited concerns over the facility's lack of proper bedding and basic amenities, and the child's ongoing gastrointestinal medical needs. The U.S. Attorney's Office had acknowledged the arrest occurred without a warrant but said one was issued afterward.

Honduran mechanic returns to U.S. custody after judge's deportation order

Jose Eliezer Martinez-Andino, a 20-year-old mechanic from Raleigh, North Carolina, and father to a U.S.-citizen daughter, was deported to Honduras in April after agents detained him in Montana, denied him contact with attorneys for about ten days, and had him sign a voluntary-departure form despite his Special Immigrant Juvenile Status and work permit. U.S. District Judge Beryl Howell found the removal denied him due process, calling the circumstances "coercive," and ordered the government to return him; he said he had been afraid in Honduras due to childhood abuse by his father. He flew back to Texas on Aug. 5 after about five months abroad, was held in CBP custody, and was then transferred to ICE custody at the Port Isabel Processing Center, where he awaits a bond hearing to determine whether he can continue proceedings closer to Raleigh. DHS has disputed his account, saying he entered the country without authorization and was released by the Biden administration, and denies he was blocked from contacting legal counsel.

Montana man held without charges by Border Patrol ordered released by judge

Jesus Verde Hernandez, a Worden man who has lived in Montana for 10 years with his partner of 14 years and their three children, ages 9, 6 and 4, was arrested on July 30 by Customs and Border Patrol without a warrant or probable cause while agents searched for another man they said resembled him. He is also stepfather to his partner's two adult children, and his partner and all five children are U.S. citizens. During his 30-hour transport between Lewistown, Jordan, Malta, Havre and Great Falls, he was given only crackers and water, denied medication for chronic pain, and pressured by federal authorities to self-deport. Chief District Judge Brian Morris ordered his release, ruling the detention violated his constitutional rights and that the government lacked statutory authority to hold him, and his attorneys at Upper Seven Law are pursuing class certification for roughly 17 people similarly detained at the Cascade County Detention Center, with a court order barring authorities from moving any of them out of Montana before an Aug. 18 hearing in Missoula.

ICE agent draws gun on mother near school during enforcement operation in Bozeman

On July 1, 2026, Bozeman resident Brandi Straub was driving near Camp Equinox summer theater camp, about 10 minutes after dropping off her daughter, when ICE agents conducting an enforcement operation pursued two men who had jumped from a moving pickup truck after it sideswiped a post. An agent ran past her vehicle and pointed a gun through her passenger window before continuing the pursuit. Straub's 12-year-old daughter and a neighbor's 11-year-old were at the camp, three blocks away with about 120 children present; she called the camp director, who had not been notified of the operation but was already keeping children inside due to a storm. When Straub called 911, dispatch told her local police could not intervene in ICE operations.

Bozeman caregiver detained over 24 hours by ICE, fights arrest in federal court

David Cortes-Torres, a 20-year-old man and primary caregiver for his grandmother who is undergoing cancer treatment, was detained by ICE agents in Bozeman on Monday. According to a federal habeas corpus petition filed by Upper Seven Law, agents held him for more than 24 hours at Helena Airport in a small holding room with over 15 other people, pressured him to voluntarily leave the country, and limited his attorney contact to a single three-minute phone call. His lawyers allege the arrest was part of an operation targeting Latinos in the area, and a federal judge ordered him to remain in Montana pending a hearing set for the following Tuesday.

Gallatin County residents detained in ICE raids top 100, fear deepens

ICE conducted multiple operations in and around Bozeman and Gallatin Gateway from late June into early July, with community group Bienvenidos a Gallatin Valley reporting 25 to 30 detentions between a Monday and Tuesday, more than 80 on the following Wednesday, and additional arrests continuing into Thursday, bringing the total above 100. Residents describe agents pulling over vehicles and detaining all occupants, knocking on doors in search of specific individuals but detaining others present, and in some cases detaining people with legal authorization to be in the country. On the morning of June 29, Bozeman resident Brandy Straub was dropping her daughter and a neighbor's child at a summer theater camp at Bozeman Summit School when two ICE agents chased fleeing men with guns drawn near her car, with one agent pointing a weapon toward her vehicle. In response, Bienvenidos a Gallatin Valley organized emergency deliveries of groceries, toiletries, diapers, infant formula, and other household supplies to nearly 160 households across Gallatin County between June 26 and July 7.

20-year-old detained by ICE after traffic stop, law firm challenges arrest in federal court

Jose David Cortes Torres, a 20-year-old noncitizen who has lived in Bozeman since 2023, was pulled over on June 29 while driving to work by ICE agents in an unmarked white Dodge Durango. According to court documents, agents asked for his driver's license, told him he had no right to be in the United States, and arrested him without charging him with a crime. He was detained for more than 24 hours in a holding room at the Helena airport with more than 15 other individuals, forced to stand for approximately six hours due to cramped conditions, and was limited to a single three-minute phone call with attorneys. He was told to voluntarily self-deport or face months of lockup. His lawyers at Upper Seven Law filed a habeas corpus petition in federal court alleging the arrest violated constitutional due process rights and was part of a dragnet operation targeting Latinos based on race and language, without individualized suspicion. Cortes Torres is the primary caretaker for his grandmother, who is undergoing cancer treatment.

Diesel mechanic freed after 109 days in ICE detention, judge rejects Trump detention policy

Roberto Orozco-Ramirez, an undocumented Mexican immigrant who had lived in Froid, Montana for 25 years and built a successful diesel repair business, was arrested by Border Patrol agents on January 25, 2026, after they staked out his home. He was charged with illegal reentry, but the government dropped that charge in April 2026, and he remained detained under the Trump administration's expanded mandatory detention policy for undocumented immigrants. Orozco-Ramirez is a father of four U.S. citizen children with no criminal record. The small, conservative town of Froid organized community fundraisers to support his family during his detention. On May 14-15, 2026, U.S. District Court Chief Judge Brian Morris ruled that his continued detention was unlawful, finding the administration's interpretation of mandatory detention law erroneous and in violation of due process and constitutional rights, and ordered his immediate release from the Cascade County Detention Center.

Venezuelan man held on $200,000 bail, charged with raping child in Montana

Wualter Jesus Travieso Soto, 29, was arrested February 1, 2025, and charged with felony sexual intercourse without consent with a child under 16 after the victim's aunt obtained guardianship and the girl reported multiple assaults. Soto, who entered the U.S. without authorization in 2023, remains in Flathead County jail on $200,000 bail with an ICE detainer. He pleaded not guilty at his April 9 arraignment, with his next court date scheduled for August 3, 2026.

Honduran SIJS holder deported despite status, ordered returned to detention in Texas

José Eliezer Martínez-Andino, a Honduran man with Special Immigrant Juvenile Status and a work permit who crossed into the U.S. alone at 14 in 2020 and later settled in Raleigh, North Carolina, working as a mechanic, was stopped by Border Patrol agents on March 18, 2026, in Montana while traveling toward Seattle over an alleged forged license plate. He signed a voluntary departure form he says he tried to retract while being shuttled between detention facilities in Montana and Arizona; his attorney, Alison Chan, filed notice of representation on March 31 but could not get ICE or CBP to disclose his location before he was deported on April 10 to his birth city of Tela, Honduras, separating him from his 3-year-old U.S.-citizen daughter and family in Raleigh. A federal judge later ordered the government to bring him back, but when he returned in August he was sent to an ICE detention facility in Texas rather than home, and DHS has filed a new removal case against him.

17 undocumented immigrants detained in Bigfork construction site raid

ICE Homeland Security Investigations Kalispell, with support from Spokane Border Patrol, conducted a worksite operation at a construction site in Bigfork on March 4, 2025. Acting on a tip, agents served a notice of inspection and encountered 17 undocumented immigrants. All 17 were taken into custody and found ineligible to remain in the United States. The investigation remains ongoing.

Mexican citizen arrested after ICE agent called to trespassing scene in Great Falls

Duran Valdivias, a Mexican citizen working for a local property manager, was arrested by ICE agents on February 13 after a Great Falls Police Department detective called an ICE agent to a suspected trespassing scene. According to court documents, ICE discovered that Valdivias had been detained by U.S. Customs and Border Patrol five times in 2012 and had been ordered to stay out of the country.

Father and Daughter, Then Another Family, Detained by CBP After Billings School Supplies Event

A 36-year-old father, Adrián Espinoza De La Cruz, and his 9-year-old daughter were detained by U.S. Customs and Border Protection on Aug. 11 after leaving a United Way of Yellowstone County backpack giveaway in Billings, Montana, and were driven 250 miles to a detention facility in Havre. CBP said agents pulled over a driver at 10:15 a.m. near Overland Avenue; a federal judge later ordered the pair released, finding agents lacked probable cause or a warrant. United Way CEO Andrew Konkel said agents appeared to be staying at a nearby hotel and may have targeted families leaving the event, raising concerns about whether the event was being monitored for enforcement purposes. A second family was detained the next day after attending the same event and was later found to have legal status and released. Following the detentions, United Way warned more than 100 area nonprofits and began developing training on responding to immigration enforcement near community events.
