Senators propose bill to curb warrantless ICE arrests, indefinite detention
Sep 25, 2026

Democratic senators Dick Durbin and Alex Padilla introduced the 'Immigration Warrant Reform Act' to limit warrantless ICE arrests and indefinite detention. The bill would require an administrative warrant with probable cause, a bond hearing within 24 hours of warrantless arrests, and custody reviews every 60 days by a judge. The senators cited cases including George Retes, Javier Ramirez, Andrea Velez, Wilmer Chavarria, and Dayanne Figueroa as examples of U.S. citizens and lawful immigrants wrongly detained during enforcement operations. They also pointed to the Supreme Court's Noem v. Vasquez Perdomo ruling, in which a concurrence allowed stops based on factors like apparent ethnicity, language, or presence at certain worksites, while a dissent warned that U.S. citizens were being seized and removed from their jobs.
