U.S. District Judge Lewis A. Kaplan issued a 125-page permanent injunction requiring ICE to improve detention conditions and end overcrowding at its 26 Federal Plaza holding facility in New York. The ruling followed a class action lawsuit, originally filed in August 2025 by Sergio Alberto Barco Mercado, after ICE held more than 100 people, sometimes for weeks, without beds, showers, or adequate medical care, and banned confidential legal visits and communications. Kaplan found ICE had repeatedly violated an earlier preliminary injunction, used undisclosed floors to hold detainees, and “sanitized the record” of conditions he likened to a “black site.” The order requires adequate sanitation, meals, and medical care, and mandates confidential attorney phone calls within an hour of arrival.
