Supreme Court likely to reject Trump birthright citizenship order
Aug 5, 2026·Location: Brooklyn, NY
Country of origin: Haiti

The Supreme Court ruled 6-3 in Mullin v. Doe that the Trump administration can cancel Temporary Protected Status (TPS) for Haitians and Syrians, determining that the Department of Homeland Security has broad discretion with minimal judicial oversight to decide when TPS designations must end. The decision affects approximately 1.3 million TPS holders nationwide, including over 113,000 Haitian TPS holders in Florida, more than 10,000 in Ohio, and approximately 350,000 Haitian nationals overall. TPS recipients will lose work authorization and become undocumented when the termination becomes effective July 24th, threatening healthcare workers, caregivers, food service workers, and other essential laborers. Justice Kagan dissented, noting that President Trump made racially inflammatory statements about Haiti. Community leaders, elected officials, labor advocates, and immigration advocates warn the decision will result in mass family separations, significant workforce disruptions, and people facing deportation to countries experiencing gang violence, civil war, and humanitarian crises.
