Trump Administration Petitions Supreme Court to Reinstate Border Asylum Ban
Aug 25, 2026

The Trump administration asked the Supreme Court to review and reverse a D.C. Circuit ruling that blocked its proclamation restricting asylum access for migrants crossing the border illegally. The appeals court had upheld a lower court decision finding the policy unlawful for bypassing standard asylum and withholding of removal procedures. The administration argues the restrictions are necessary to control an 'invasion' at the southern border and says the policy has significantly reduced illegal crossings. Thirteen migrant plaintiffs and advocacy groups suing over the policy say it has separated asylum-seeking families and sent some migrants to third countries like Costa Rica or Panama, forcing many back into potential persecution.
